Admitted using vehicle in dangerous condition

When police stopped a car which had smoke bellowing from its exhaust an examination revealed that it had a number of defects.

Chris Faloon (21), Ferngrove Park, Craigavon, admitted using a vehicle in a dangerous condition on July 15 last year.

He was fined £100 for this offence last Friday at Craigavon Magistrates Court.

Faloon was also fined £100 and banned for three months for not having insurance, fined £75 with a concurrent three months ban for not having a licence and fined £100 for obstructing police.

The court heard that at 6pm police stopped a car being driven by the defendant.

It had smoke bellowing out of the exhaust and the wheel alignment appeared to be off.

Faloon was asked to produce his licence and insurance but he did not have any.

The vehicle was seized by police and examined by an authorised officer to gauge its roadworthiness.

Among the defects discovered were that the offside front wheel was sitting out and this would have affected the steering, handling and braking while the wheels and tyres were oversized for the vehicle.

At the time of the offence Faloon gave an incorrect name to the police.

He had a previous conviction for driving without due care and attention.

A solicitor representing the defendant said his client had his licence revoked under the new driver legislation.

He explained that Faloon had bought the vehicle with the intention of re-sitting his test. The car needed work on it and he should not have been driving it because of its poor state.

The solicitor added that the defendant had panicked and gave an incorrect name to the police.

District Judge Oonagh Mallon said that Faloon had not started his driving career very well.

She added that the car was in such a condition it could have caused an accident and it was a risk to other people.

The judge said it was highly irresponsible for the defendant to get into a car like that and drive it.
