Bar owner fined after man’s death in stairs fall

The owner of a bar/nightclub in Portadown has been fined £3,000 after a customer fell down a stairway on the premises and died days later.

The case against Jacques Grillion of La Bamba in Thomas Street was brought by Armagh City, Banbridge and Craigavon Borough Council and was heard at Craigavon Courthouse on Tuesday.

The accident involving Alan McClelland (69), from Portadown, took place on September 15, 2014. Mr McClelland died 11 days later.

Mr Grillion was accused of failing to conduct the undertaking to ensure, as far as is reasonably practicable, persons not in their employment are not exposed to risks to their health and safety.

He was also ordered to pay £1,500 in costs.

Judge Marshall said, “The condition of the stairs was absolutely appalling and why the owner did not give them due attention beggars belief.” A council spokesperson said, “Employers must ensure the health and safety of both employees and members of the public is maintained on premises and all necessary maintenance is carried out to ensure safety.”
