Police found 223 fireworks in garage

When police found 223 assorted fireworks in a lock up garage in Lurgan a 34-year-old man said he had confiscated them from his son and children in the estate.

David Martin Peter Somers, whose address was given as Deans Walk, Lurgan, admitted a number of charges last Friday at Craigavon Magistrates Court.

He was fined £200, with a £15 offender’s levy, for possession of fireworks without a licence on October 24 last year.

Fines of £60 were imposed on each of five charges of having a prohibited firework on the same date.

They were a ‘Tapirki’ banger, a ‘Bad Boy Fireball’ rocket, a ‘Bad Boy Thunder, rocket, a ‘Demon Detonator’ rocket and a ‘Snakebite’ Roman Candle.

The court heard that police went to a lock up garage at Deans Walk and on arrival were informed there was no connection to the defendant.

Just as police were going to force entry Somers arrived on the scene and said he had confiscated the fireworks the day before from his son.

There were 223 assorted fireworks in the lock-up and Somers did not have a licence for them.

When interviewed he claimed that he had confiscated them from children in the estate over the previous day.

A solicitor representing Somers said he would say he confiscated from children in the area and stored them before disposing of them,

He explained that his client had not applied for a licence because he thought that because of his record he would not get a licence.

The solicitor added that it was the defendant’s partner who had said he had no connection with the lock up but when Somers knew police were in the area he went to them.

As well as imposing the fines District Judge, Mr Mervyn Bates, issued a destruction order for the fireworks.
